Welcome to Emira Auto Group, LLC. These Terms and Conditions (“Agreement”) govern your use of our services, website, and any purchase or transaction made through our dealership. By accessing our website or purchasing a vehicle or related services, you agree to comply with and be bound by these Terms.

1. Vehicle Sales and Purchase Agreement
All vehicle purchases are governed by a Retail Installment Sale Contract or Bill of Sale, which serves as the final and binding agreement. All sales are subject to applicable California Vehicle Code, DMV regulations, and federal compliance, including the Truth in Lending Act (TILA) and Used Car Rule enforced by the FTC.
• AS-IS Sales: Unless otherwise stated in writing, all vehicles are sold AS-IS, with no warranty expressed or implied.
• Certified or Warrantied Vehicles: Vehicles labeled as “Certified” or “Warrantied” include documentation detailing coverage terms.
• Odometer Disclosure: We comply with all Federal Odometer Act requirements. Accurate mileage will be disclosed at the time of sale.

2. Pricing and Payment Terms
• All prices listed are exclusive of taxes, title, registration, dealer fees, and shipping costs unless explicitly stated otherwise.
• Prices are subject to change without notice prior to a final signed agreement.
• Accepted payment methods include certified check, wire transfer, financing (subject to credit approval), and cash (per IRS reporting limits).

3. Deposits and Holds
• A deposit may be required to hold a vehicle. Deposits are non-refundable unless stated otherwise in writing.
• We reserve the right to sell any vehicle unless a hold agreement is in place and confirmed in writing.

4. Vehicle Delivery and Shipping
• Vehicle deliveries and shipments are governed by our separate Shipping Policy.
• Title transfer and delivery may take up to 30 days based on lien release and state processing timelines.

5. Trade-Ins
• All trade-in vehicles must be legally owned, free of undisclosed liens, and accurately represented.
• Trade-in values are estimates until a physical inspection is completed.

6. Website Use and Content
• All materials on our website are for informational purposes only and do not constitute a legally binding offer.
• We do our best to ensure accuracy, but Emira Auto Group, LLC is not liable for typographical or pricing errors.

• Loss or damage during shipping when arranged by third parties.

9. Dispute Resolution and Governing Law
• This agreement shall be governed by the laws of the State of California, without regard to conflict-of-law provisions.
• Any disputes shall be resolved in San Bernardino County, California, through binding arbitration or small claims court as appropriate.
• Each party waives its right to a jury trial in any legal proceeding.
